Terms of Service

Last updated: August 2026

§ 1 Scope and provider

(1) These Terms apply to all contracts for paid services concluded between Thomas Kinzel, Milbinger Straße 23, 83098 Brannenburg, Germany (the "Provider") and the user via the website treatherright.net.

(2) A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business or profession (§ 13 BGB).

(3) Deviating terms of the user do not become part of the contract unless the Provider expressly agrees in text form.

§ 2 Subject matter

(1) The Provider makes available a web-based application (the "App") at treatherright.net. Based on information entered by the user, the App builds a cycle model and displays daily recommendations, phase-change alerts, an emergency-help module and a calendar export.

(2) The App is provided as a Progressive Web App and used through a web browser. It is not distributed via app stores.

(3) The scope of service owed is determined by the service description on the website at the time the contract is concluded.

§ 3 Not medical, therapeutic or psychological advice

(1) The App is an information and orientation tool. It is not a medical device, not a diagnostic instrument, and not a means of contraception.

(2) The content of the App does not replace medical, therapeutic or psychological advice.

(3) The App must not be used for contraception, family planning, determining fertile or infertile days, or determining or monitoring a pregnancy. The cycle phases shown are based on a statistical average model and do not reliably represent the actual cycle of any specific person.

(4) In the event of health complaints or questions, medical advice must be sought.

§ 4 Minimum age

(1) Contracts may only be concluded by natural persons of full legal capacity who have reached the age of 18.

(2) By placing an order, the user confirms that they are of full age.

§ 5 Information concerning third parties

(1) The App processes information relating to a person other than the user, in particular her first name and information about her menstrual cycle. This information is stored exclusively in the local storage of the user's device and is not transmitted to the Provider. The Provider has no access to it.

(2) The user warrants that the person concerned is aware of the use of the App and consents to her information being entered.

(3) The user shall indemnify the Provider against all third-party claims arising from the user entering information without the consent of the person concerned, contrary to paragraph 2.

§ 6 Conclusion of contract

(1) The presentation of plans on the website does not constitute a binding offer but an invitation to submit an offer.

(2) By activating the order button in the payment process, the user submits a binding offer to conclude a contract.

(3) The contract is concluded when the Provider accepts the offer, at the latest upon activation of access or upon receipt of the order confirmation by email.

(4) The Provider does not separately store the contract text. The contract language is German or English, depending on the language version chosen by the user.

§ 7 Prices and payment

(1) The prices stated on the website at the time the contract is concluded apply.

(2) In accordance with § 19 UStG, no VAT is charged and none is shown.

(3) Payments are processed by the payment service provider Stripe, whose terms apply in addition.

(4) For subscriptions, the fee is payable in advance at the start of each billing period.

(5) If a payment fails for reasons attributable to the user, the Provider may temporarily suspend access until settlement.

§ 8 Term and termination

(1) The "Monthly" plan is concluded for an indefinite period and billed monthly. It may be terminated at any time with effect from the end of the current billing period.

(2) The "Annual" plan has an initial term of twelve months. After the initial term it continues for an indefinite period and may be terminated at any time with one month's notice.

(3) The "Lifetime" plan is a one-off purchase. It does not create a continuing obligation, does not renew, and requires no termination.

(4) Termination may be declared at any time without giving reasons, in particular via the "Cancel contracts here" button on the website or by email to info.treatherright@gmail.com.

(5) The right of both parties to terminate for good cause remains unaffected.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details and the model withdrawal form are set out at /legal/withdrawal.

§ 10 Voluntary money-back guarantee

(1) In addition to the statutory right of withdrawal, the Provider grants a voluntary money-back guarantee of fourteen days from the date of purchase.

(2) The guarantee is a voluntary contractual benefit and does not limit the user's statutory rights.

(3) It is claimed by informal email to info.treatherright@gmail.com from the email address used at purchase. Access to paid content ends upon refund.

§ 11 Availability

(1) The Provider endeavours to keep the App available without interruption. No specific level of availability is owed.

(2) Maintenance, disruptions to internet infrastructure, outages at service providers used, and force majeure may cause temporary restrictions.

(3) If the App is unusable for more than 72 consecutive hours for reasons attributable to the Provider, the fee paid for that period will be refunded pro rata on request.

§ 12 Rights of use

(1) The user receives a simple, non-transferable and non-sublicensable right to use the App's content for their own private purposes.

(2) Not permitted: sharing access credentials with third parties, use of one account by several people, commercial exploitation, reproduction or publication of the content, and automated extraction of the App.

(3) All rights in the content, texts, designs and software remain with the Provider.

§ 13 Changes to and discontinuation of the service

(1) The Provider may further develop the App and change or replace individual functions, provided the purpose of the contract is not jeopardised and the change is reasonable for the user.

(2) The Provider may discontinue the service entirely, giving three months' notice by email.

(3) In the event of discontinuation, fees paid in advance for unused subscription periods will be refunded pro rata.

(4) If the service is discontinued within 24 months of the purchase of a "Lifetime" plan, the Provider will refund the purchase price pro rata, in proportion to the time remaining until the end of those 24 months.

§ 14 User obligations

(1) The user must provide a valid email address at registration and notify changes without delay. Access is activated exclusively for the email address used at purchase.

(2) The user must keep access credentials confidential and inform the Provider immediately if misuse is suspected.

(3) Cycle data entered in the App is stored exclusively on the local device. Deleting browser data or changing browser or device causes irretrievable loss of this data. Restoration by the Provider is technically impossible.

§ 15 Liability

(1) The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulent concealment of a defect, within the scope of a guarantee assumed, and under the Product Liability Act.

(2) In cases of simple negligence, the Provider is liable only for breach of a material contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the user may regularly rely. In that case liability is limited to the foreseeable damage typical for this type of contract.

(3) Liability is otherwise excluded.

(4) The Provider is not liable for decisions the user makes on the basis of the App's content, in particular health-related decisions or decisions within a personal relationship.

(5) The above limitations also apply for the benefit of the Provider's vicarious agents.

§ 16 Technical requirements

(1) Use of the App requires a current web browser and an internet connection.

(2) Push notifications on Apple devices require iOS 16.4 or later and installation of the App on the home screen. The Provider does not owe the functioning of push notifications on third-party devices.

§ 17 Changes to these Terms

(1) The Provider may amend these Terms where necessary to adapt to changed legal requirements, changed case law, or changed technical or economic conditions, and where this does not unreasonably disadvantage the user.

(2) Changes will be communicated in text form at least six weeks before taking effect. If the user does not object within that period, the changes are deemed accepted. The notice will separately draw attention to the period and the significance of silence.

(3) If the user objects, either party may terminate the contract with effect from the date the change takes effect.

§ 18 Data protection

Details of the processing of personal data are set out in the Privacy Policy at /legal/privacy-en.

§ 19 Consumer dispute resolution

The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 20 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

(2) Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
